1. Introduction and Acceptance
Welcome to Sole Obsession ("Platform", "we", "us", "our"), a UK-based marketplace. These Terms of Service ("Terms") govern your access to and use of the Sole Obsession website located at sole-obsession.co.uk and all related services.
By accessing or using our Platform, you confirm that:
- You are at least 18 years of age
- You have the legal capacity to enter into binding agreements
- You agree to be bound by these Terms
- Your use of the Platform is lawful in your jurisdiction
IF YOU ARE UNDER 18 YEARS OF AGE, YOU MUST NOT ACCESS OR USE THIS PLATFORM.
2. Nature of the Platform
Sole Obsession is an online marketplace that facilitates transactions between adult buyers and sellers of pre-worn socks and related items. The Platform is intended exclusively for users who are 18 years of age or older.
Sole Obsession acts solely as an intermediary platform connecting buyers and sellers. We do not manufacture, own, or directly sell any products listed on the Platform. All transactions are between individual buyers and sellers.
3. Account Registration and Security
To use certain features of the Platform, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.
4. Age Verification
All users must complete age verification before using the Platform:
- Buyers: Must complete facial recognition verification before making purchases
- Sellers: Must complete full identity verification (KYC) including government-issued ID and liveness check before listing items
Age verification is processed by our third-party verification provider. We do not store copies of your identity documents after verification is complete.
5. Seller Requirements
All sellers on Sole Obsession must:
- Be at least 18 years of age
- Complete full identity verification (KYC) and liveness check
- Register for payment processing through Stripe Express
- Provide accurate descriptions of all listed items
- Ship items within the stated timeframe
- Comply with all applicable laws and regulations
- Maintain accurate tax records for their sales
6. Prohibited Content and Conduct
The following content and conduct are strictly prohibited:
- Any content involving minors (under 18)
- Non-consensual content of any kind
- Content depicting illegal activities
- Harassment, abuse, or threatening behaviour
- Fraud, misrepresentation, or deceptive practices
- Intellectual property infringement
- Distribution of malware or harmful code
- Spam, unauthorized advertising, or solicitation
- Attempting to circumvent Platform fees or systems
- Creating multiple accounts to evade restrictions
Violation of these prohibitions may result in immediate account termination and may be reported to relevant authorities.
7. Payments, Fees, and Billing
Payment Processing
All payments are processed securely through Stripe. By making a purchase, you agree to their terms of service.
Billing Descriptor
Charges will appear on your statement as "SOLEOBSESSION" or "SO". For billing inquiries, contact enquiries@sole-obsession.co.uk.
Platform Fees
Sole Obsession charges sellers a commission on each successful sale. Current fee rates are displayed in your seller dashboard.
Currency
All prices are displayed and charged in British Pounds Sterling (GBP) unless otherwise indicated.
Recurring Billing
If you subscribe to any recurring services, you authorise us to charge your payment method automatically until you cancel. You may cancel recurring subscriptions at any time through your account settings.
Featured Seller Subscription
The Featured Seller subscription is a recurring monthly service priced at £9.99 per month unless a promotional rate has been offered and accepted. By subscribing, you agree to the following:
- You will be charged £9.99 (or your agreed promotional rate) on the same date each month, beginning on the date of your initial purchase.
- Your subscription renews automatically each month until you cancel.
- You may cancel at any time from your Seller Dashboard. Upon cancellation, your Featured status will remain active until the end of your current paid billing period.
- No partial refunds will be issued for unused portions of a billing period.
- Featured Seller status provides priority placement, a profile badge, and homepage showcase visibility. It does not guarantee additional sales or specific levels of traffic.
- If you cancel and later wish to resubscribe, the standard rate of £9.99/month will apply regardless of any previous promotional pricing.
Customer Subscription Plans
Customer subscription plans provide monthly credits to claim pre-worn socks from opted-in sellers. By subscribing, you agree to the following:
- Starter Plan: £32 per month — 1 credit per month.
- Regular Plan: £96 per month — 3 credits per month.
- Premium Plan: £160 per month — 5 credits per month.
- You will be charged on the same date each month, beginning on the date of your initial purchase.
- Your subscription renews automatically each month until you cancel.
- You may cancel at any time from your Customer Account page. Upon cancellation, your remaining credits will be available until the end of your current paid billing period.
- Unused credits may roll over to the next month up to a maximum of 5 credits. Credits beyond this cap are forfeited.
- No partial refunds will be issued for unused credits or unused portions of a billing period.
- Credits may only be used to claim products from sellers who have opted in to the Subscription Programme. Product availability is not guaranteed.
- Shipping charges of £5.99 per seller per order still apply to subscription claims.
Cancellation and Refund Policy for Subscriptions
All subscription cancellations take effect at the end of the current billing period. You will continue to receive the benefits of your subscription until that date. No refunds are issued for partial billing periods. To cancel, use the cancellation option in your dashboard or account settings, or contact us at enquiries@sole-obsession.co.uk.
8. Refunds and Dispute Resolution
Due to the nature of the products sold on Sole Obsession, all sales are generally final. However, refunds may be issued in the following circumstances:
- Item not received after the stated delivery period
- Item significantly not as described
- Duplicate charges or technical billing errors
To request a refund, contact our support team within 14 days of purchase. We will investigate all disputes fairly and make a determination within 7 business days.
9. Intellectual Property
All content, trademarks, and intellectual property on the Platform are owned by or licensed to Sole Obsession, except for user-generated content which remains the property of respective users.
By uploading content to the Platform, you grant Sole Obsession a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating the Platform.
10. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
11. Disclaimers and Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOLE OBSESSION AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless Sole Obsession, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any rights of third parties.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
